Please read these General Terms and Conditions before using the site. Visualnet.com is an Internet domain owned by the private company Servicios Informáticos Visualnet, S.A. (hereinafter VISUALNET; further company details are mentioned at the bottom of this document).

1. GENERAL CONDITIONS AND ACCEPTANCE THEREOF

These general terms and conditions regulate the service of the website at www.visualnet.com, which VISUALNET places at the disposal of the User. The use of the website attributes the General Terms and Conditions to the User and presupposes the full unreserved acceptance by the User of each and every general term and condition. Should the User not accept the general conditions, he shall not have the right to use the website at www.visualnet.com. Certain services, specifically for Users interested in registering as subscribers of VISUALNET, are subject to particular conditions that supplement these general conditions or, in certain cases, replaces them. The contents of the particular conditions shall be provided to the User when the latter accesses a specific service.

2. ACCESS TO AND USE OF THE WEBSITE IS FREE

The provision of the website service by VISUALNET is free for the User and does not require prior subscription or registration. However, in order to access certain services the User must subscribe to VISUALNET.

3. MODIFICATIONS OF THE WEBSITE OR SERVICES VISUALNET

VISUALNET reserves the right to unilaterally and at any time without notice modify the presentation or configuration of the website and its services, as well as the general or particular conditions. Such modifications shall be to improve the services available to the User in accordance with market trends.

4. CORRECT USE OF THE WEBSITE AND SERVICES

The User is obliged to use the website, its content or services in conformity with the law and the general terms and conditions herein, the particular conditions of each of the services, good practices and public order. Likewise the User is obliged not to use the website or the services offered for illicit purposes, contrary to the contents of these general conditions, damaging to the rights and interests of third parties, or in any way that would harm, incapacitate, overload or deteriorate the website or its services or impede the normal use and enjoyment of the website by other users.
The User must abstain from obtaining information, messages, graphics, drawings, sound and/or image files, photographs, recordings, software and, in general, any type of materials accessible through the website or the services, by means different from those that have been placed at his disposal or, in general, those that are normally used on the Internet.
The User shall abstain from manipulating identification data of VISUALNET or the services of the website at www.visualnet.com.
The User shall abstain from facilitating data or identification that does not allow for correct identification.
The User must abstain from handling information or technical content protection devices and, in general, devices for the configuration of the website at www.visualnet.com.
VISUALNET reserves the right to deny or withdraw access to the website at www.visualnet.com at any time and without prior notification from those Users who are in breach of these general terms and conditions or the particular conditions of the subscribers applicable to each specific service.

5. DATA OF MINORS

Minors under 13 years of age, without express authorization of their parents, shall not be allowed to subscribe. If a check reveals that the User is a minor without authorization from his parents, VISUALNET reserves the right to notify the parents of the minor of its intention to request certain personal data from the minor. At any time the parents of the minor can review, cancel or refuse the collection of further personal data of the minor by sending a message to the address of VISUALNET.

6. USE OF DATA PROVIDED BY THE USER VISUALNET

VISUALNET may conduct surveys of its users which will be for the internal use of VISUALNET. Provided that the User facilitates his personal data to VISUALNET, a link will be included to the conditions of the personal data containing the terms of consent for the treatment of such data.
Notwithstanding the provisions in the particular conditions of the specific services for the subscribers, VISUALNET shall treat and incorporate the data provided by the User into a file exclusively for the purpose of allowing the User to be informed of the developments of the website at www.visualnet.com and in order to provide and offer VISUALNET services and process them.
In order to access certain services offered by VISUALNET the User should provide VISUALNET with the data indicated on the on-line registration form. In order to be able to personalize the services and adjust them to the Users' interests and needs, it is requested that the User periodically update such information. The User shall be able to edit his information at any time by using his VISUALNET User Name and Password. If the User Name and / or Password is forgotten or lost, VISUALNET must be contacted by mail or e-mail in order to obtain a new one.
By providing personal data on the electronic form, the User consents thereby to the treatment of such data by VISUALNET under the terms set forth in this clause on data protection. This policy may change; therefore, we recommend that the User consult the policy periodically.
In compliance with the provisions of Law 15/1999 of 13 December on Personal Data Protection (LPD), VISUALNET hereby informs that Users' personal data shall be entered and treated in VISUALNET's files in order to process it and to provide the User with an efficient service with which to develop his business.
VISUALNET shall also have the right to register the Users' IP addresses in order to diagnose any problems, and for administrative purposes as well. VISUALNET reserves the right to ask for additional information to establish and maintain the subscriber's account with the VISUALNET website.
VISUALNET may send the User e-mail messages related to its services, in accordance with the form filled out. Nevertheless, if the User does not want VISUALNET to send him information, he or she should inform VISUALNET management.
Furthermore, VISUALNET informs the User of the possibility of exercising his rights of, and to, access, rectification, cancellation and refusal in respect of his personal data, where VISUALNET itself is responsible for his file, by writing to Putget, 73 3-3, 08023, Barcelona or by e-mail under the terms established in the LPD.
The User hereby gives his consent so that his data may be communicated to third-party companies for purposes directly related to the legitimate functions of VISUALNET and the third-party company in order to be able to better manage the information of interest and in accordance with the electronic form filled out, including the use of cookies (see also: 10. BROWSING WITH COOKIES). VISUALNET shall not reveal any further personal data to any other third party than that stipulated in this document. Any correspondence between VISUALNET and its users is private and cannot be viewed by a third party.
VISUALNET guarantees that it will treat personal data confidentially and that the server in which the data is stored and treated is equipped with the security measures required to avoid access to such data by unauthorized third parties.

7. LIMITATION OF GUARANTEES AND RESPONSIBILITIES VISUALNET

VISUALNET neither controls nor guarantees the absence of viruses or other elements in the contents that could produce alterations to the User's information system (software and hardware) or to the electronic documents and files stored in his information system. VISUALNET holds itself harmless from any responsibility for damages of any type that may arise from the presence of a virus or the presence of other elements in the contents that could produce alterations in the user's information system, electronic documents or user files.
VISUALNET will do everything possible to guarantee the security of the information that is provided by the users. Nevertheless, it cannot guarantee that the transmissions of information will be totally secure.
Notwithstanding the levels of security for the protection of personal data that are required by law, and the installation of all technical means and measures available to avoid the loss, misuse, alteration, unauthorized access to and theft of the data provided, the User must know and acknowledge that security in the Internet environment cannot be fully guaranteed.
VISUALNET holds itself exempt from any responsibility for damages of any type that may arise from the lack of veracity, exactness or thoroughness of the contents (or the fact that they may be out of date) of the website at www.visualnet.com.

8. COPYRIGHT AND INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS

All the contents of the website at www.visualnet.com, including, and without limitation, graphic design, logos, images, texts, illustrations, photographs, audiovisuals, brands and other distinctive signs, in any programming language used or usable, as well as all operating and development software of the website are the exclusive property of their authors. The reproduction, distribution, communication to the public, cession and any other act or form of exploitation that has not been expressly authorized by the titleholder of the exploitation rights is expressly prohibited.
VISUALNET does not grant any license or authorization for the use of any type of its intellectual and industrial property rights or any other type of property right including those related to the website and the services offered.
In the case of data or content provided by the User to the website at www.visualnet.com, the User grants VISUALNET the non-exclusive right, exempt of copyright or intellectual property rights, in perpetuity, irrevocably and totally transferable to third parties, to use, reproduce, modify, adapt, publish, translate, transform into derivative services, distribute or exhibit any such contents throughout the world and through any communication media. The User also grants VISUALNET and its sub-licensers the right to use the name that accompanies such content.
In any event, the rights conferred upon VISUALNET by virtue of this paragraph shall be considered lawfully granted exclusively for the purposes of its management needs in respect of the web-site www.visualnet.com.

9. LINKS

The website often provides the User with linking devices (links, banners or buttons), directories and search tools to allow him to access websites belonging to and/or managed by third parties. VISUALNET does not offer or market or distribute by itself or through third parties the services available at the linked websites, nor does it control, watch over or approve of the services, contents, information, data, files or any other type of material found at such linked websites.
VISUALNET therefore declines any responsibility in respect of the information found outside of its website and not managed by www.visualnet.com. The function of the links that appear is exclusively that of informing the User of the existence of other sources of information on the material in the Internet, where the User can expand the data offered at this website. Such links do not imply a suggestion, invitation or recommendation in respect of visiting such sites, and, therefore, VISUALNET shall not be responsible for the results obtained through such hypertextual links.

10. BROWSING WITH COOKIES

A portion of the VISUALNET services that can be personalized uses cookies to store and control personal data. A cookie is a small volume of data that a Web server sends to its browser. The cookie is stored on the hard disk of the User's computer. Some of the VISUALNET sites to which the User requests a connection, and which can be personalized, gives the subscriber the option of accepting cookies. In order to use the VISUALNET website as a User it is not necessary to accept cookies.
Cookies are generally used to:
Remind VISUALNET who the User is and obtain access to information on his account stored in VISUALNET computers in order to offer better, more personalized services. This cookie is installed during the registration process or entry process and is modified when discontinuing VISUALNET services.

11. LEGISLATION AND JURISDICTION
The general terms and conditions herein, as well as any and all relations between the User and VISUALNET, shall be subject to Spanish legislation.
Both parties shall submit any litigation deriving from the existence or contents of these general terms and conditions or the relations between the User and VISUALNET to the Courts and Tribunals of the City of Barcelona and hereby waive their right to their own jurisdiction should it be otherwise.
